    Types of Injury Damages

In personal injury law, damages are broken down into two main categories: economic and non-economic. In some states, punitive damages are also awarded based on the law. Here is how each is calculated.

This type of damages is the cumulation of all monetary expenses that you experience as a result of the accident. These include the costs of things like hospitalization, doctors’ appointments, medication, medical equipment, follow-up appointments, and physical therapy. They also would include lost wages as a result of missing work or having to use PTO. Personal injury lawyers will be able to tabulate a line-item list of economic damages.

These refer to the inconvenience, mental anguish, and physical pain often associated with accidents. Non-economic damages are often referred to by the catchall phrase “pain and suffering.” This category of damages can be difficult to calculate because they don’t result in an actual monetary cost. It takes experienced personal injury lawyers to calculate appropriate damages based on case law and other guidelines.

Some states allow for punitive damages in cases where the actions of the defendant were egregious enough to warrant a punishment above and beyond other damages that are awarded by the courts.

    How Personal Injury Cases Work

When an accident victim meets with a personal injury attorney, they will examine the viability of the claim. All personal injury cases need to possess the following four elements:

    1. Duty of Care – the individual or entity that caused the accident must have a legal duty of care to the plaintiff. For instance, a driver has a duty of care to others on the road.
    2. Breach of Duty of Care – The party who had the duty of care, failed to live up to their obligation. An example would be the proprietor of a store failing to clean up a spill in an aisle.
    3. Injury to the Plaintiff – Someone was injured as a result of the accident.
    4. Causation – The plaintiff suffered damages as a result of a breach of a legal duty of care.
If all four of these elements exist, you have the grounds for a personal injury lawsuit.

Frequently Asked Questions About Personal Injury Law

As personal injury lawyers serving clients who have been injured in an accident, we have handled numerous cases. The following are some of the most frequently asked questions and answers from our professional attorneys. If you have been injured in an accident and have questions, call now to speak with an attorney over the phone.

Personal injury attorneys work on a contingency basis, which means that they don’t accept retainers like other attorneys. They are paid at the end of your case if they reach a settlement or win a jury award. You should be able to ask any personal injury attorney near you what their fee structure is for winning a case.

Insurance adjusters work for the insurance company. Despite their responsibility to protect their insured, unfortunately based on our experience their real jobs seems all to often to mitigate payouts to injury victims. In many cases, the adjuster will improperly calculate your damages. Additionally, they will require you to sign a release of liability, preventing you from seeking further damages.

    Client Reviews

“I highly recommend attorney Jesse Bernheim and his team for any readers future needs. Mr.Bernheim handled my insurance claim in a timely manner and both him and his team kept me informed throughout the entire process. Without his representation, My claim would of been denied and I would of had several out of pocket expenses. Not only was the claim settled but it was settled for the amount needed for repairs. Thank you Jesse and hopefully I won’t need you in the future but if I do, your the first phone call made. You are a true professional.”
