    Types of Injury Damages

    In personal injury law, damages are broken down into two main categories: economic and non-economic. In some states, punitive damages are also awarded based on the law. Here is how each is calculated.

    This type of damages is the cumulation of all monetary expenses that you experience as a result of the accident. These include the costs of things like hospitalization, doctors’ appointments, medication, medical equipment, follow-up appointments, and physical therapy. They also would include lost wages as a result of missing work or having to use PTO. Personal injury lawyers will be able to tabulate a line-item list of economic damages.

    These refer to the inconvenience, mental anguish, and physical pain often associated with accidents. Non-economic damages are often referred to by the catchall phrase “pain and suffering.” This category of damages can be difficult to calculate because they don’t result in an actual monetary cost.     How Personal Injury Cases Work

    When an accident victim meets with a personal injury attorney, they will examine the viability of the claim. All personal injury cases need to possess the following four elements:

    1. Duty of Care – the individual or entity that caused the accident must have a legal duty of care to the plaintiff. For instance, a driver has a duty of care to others on the road.
